Criminal Defense Attorneys
If you are a criminal defense lawyer, from time to time, you probably come across a client who is not a United States citizen. As a result, your client's conviction may trigger removal proceedings against him or her. It is always advisable to ask your client his or her immigration status prior to starting plea negotiations. Also, as a general rule, if a conviction can be pled down to a violation or a misdemeanor, your client has a better chance to being eligible for relief from removal (it may not completely prevent the initiation of removal proceedings, but at the very least, your client may have the opportunity to seek relief from removal).

What your client pleads guilty to will determine whether the U.S. Immigration and Customs Enforcement will begin removal proceedings against him or her, whether he or she will be subject to mandatory detention, and whether he or she will be eligible for any relief from being deported.
